From time-to-time, contested matters and lawsuits arise from cases filed in the probate division of our court system, involving estates of decedents and the infirm. Herron Ortiz represents banks, beneficiaries, heirs, personal representatives, litigants and interested parties in all manner of guardianship- and probate-related disputes and lawsuits, such as will contests (involving undue influence, lack of testamentary capacity, and/or a mistake in execution), will construction, determination of heirs, elective share litigation, and breaches of fiduciary duty. The Firm is also able to handle non-adversarial administration of the probate estate as well as elder law issues, which includes helping seniors access the quality care and benefits they need while protecting their assets and incapacity planning.
